LARKANA: Senior High School Teacher Manzoor Ali Mangi has filed Execution Application in the Sindh Services Tribunal against education secretary and director schools education, Larkana region for not implementing the order of the SST.
The application has been fixed for hearing on September 08, 2015. The Chairman, Sindh Services Tribunal (SST), Justice (R) Mujeebullah Siddiqui, and Member-I Ameer Faisal, had directed the Secretary, Education & Literacy Department, Government of Sindh, Karachi, to convene meeting of Departmental Promotion Committee (DPC) within one month and consider the case of appellant Manzoor Ali Mangi for promotion from BS-16 to 17 which was due in 2012 but was deferred due to non-availability of ACRs & Service Book.
SST has further directed that his promotion shall be considered under the unamended rules prevailing in the year 2012 as the appellant has submitted that his juniors have been promoted and on promotion this fact shall be probed and considered and if the contention is found correct, the appellant shall be extended the benefit of rule 13 of Sindh Civil Servants (Probation, Confirmation and Seniority) Rules, 1975. The SST further directed that progress report shall be submitted in this office for our perusal in Chamber by the end of July 2015.
The grievance of the appellant is that he is working as High School Teacher in BPS-16 in Larkana district and his promotion was due in 2012. DPC meeting was held on 25.9.2012 for considering the cases of HSTs for awarding the post of Head Master BPS-17 on regular basis but his case was not considered for the reason that his ACR of 2012 and non-availability of Service Book. Again the DPC meeting was held on 31.01.2014 but again his case was deferred for the same reasons. The appellant produced copy of letter dated:08.10.2012 written by DEO Secondary to Director Schools Education (DSE), Larkana Region, stating that the PERs of last five years were sent along with no enquiry & no dues certificate.
The service book was also sent with a request for onward transmission to the quarter concerned. The DSE said in her statement that appellant was placed at seniority No. 28 and there were 31 vacancies available for promotion. The DSE further stated that all the promotions in other districts including the adjoining district Qambar @Shahdadkot and Shikarpur have been made but the teachers of Larkana district have not been promoted without any justification. It is mentioned here that promotion of female HSTs of Larkana district who were appointed during 1990 is also long overdue who have also been denied their basic right.
