SHC issues notices on petition against unlawful detention

KARACHI: The Sindh High Court (SHC) on Monday issued notice to home secretary, Rangers director general, provincial police chief and other officials to submit their respective comments on a petition against unlawful detention of a citizen by Rangers personnel.

Headed by Justice Ahmed Ali M Shaikh, a division bench was hearing a petition filed by Nazia Ibrahim, who moved the court seeking recovery of her brother, Shoib Hassan.

The woman petitioner submitted that Rangers personnel raided her house in Kharadar area and took away her brother on November 11. She added that since then he has been missing as paramilitary forces do not disclose his whereabouts despite repeated requests.

She argued that Rangers personnel should have produced him in court of law if he was involved in any criminal case, adding his detention by Rangers personnel was unlawful. She pleaded to the court to direct law enforcement officers to produce him in court.

Meanwhile, the same bench issued notice to federal and provincial law officers to file their responses to the petition seeking recovery of a citizen, who was detained in Lucky Marwat internment center.

The petitioner, Ameena Batool, submitted that her husband Ajmal Waheed and his brother Osama Waheed were whisked away by law enforcers from Karachi airport on July 1, 2011 after their acquittal in a terrorism-related case.

However, she said, her spouse was released later but Osama was still missing. Following the court directives, federal law officer informed it that missing man was detained in the internment center in KP.

Counsel for petitioner told the judges that later elder brother of internee had visited him in the internment center. He added Osama was seriously ill and required medical treatment by the specialists. He said internee’s elder brother wrote to the authorities of the internment center to provide medical treatment to internee but to no avail.

He requested the court to direct authorities concerned to provide medical treatment to the internee and produce him in court.
