SHC rejects DHA plea for suspension of verdict

KARACHI: The Sindh High Court (SHC) on Tuesday rejected the Defence Housing Authority (DHA)’s plea to suspend the operation of its judgment on a petition pertaining to Clifton traffic project’s EIA report for two weeks so that it could appeal the verdict in Supreme Court.

Earlier on October 17, SHC’s bench had dismissed the petition filed by DHA through which it challenged Sepa’s environmental impact assessment (EIA) report that accorded its approval to Clifton traffic project that included construction of a flyover and two underpasses in Clifton area.

Following the judgment, counsel on behalf of DHA filed a miscellaneous application pleading to the court to suspend the operation of its verdict for two week so that DHA could approach the apex court against the judgment.

After hearing arguments on the application, a division bench headed by Justice Sajjad Ali Shah observed that it was of the view that no case for suspension of the judgment is made out as it has no immediate or irreversible effect. Therefore, the bench said, application is dismissed.
