KARACHI: The Sindh High Court (SHC) on Wednesday issued notices to prosecutor general to file comments on the petition filed by a death row convict challenging his capital punishment awarded by Anti-Terrorism Court in double murder case.
ATC on 21st September had awarded death sentence to Munawwar alias David after founding him guilty of killing Mukhtiar Lashari and Ayaz and injuring Jan Mohammad in resistance to robbery.
SHC bench headed by Justice Naimatullah Phulpoto was hearing the petition filed by the convict who challenged his punishment. The court issued notices to prosecutor general Sindh to file comments on the next hearing.
According to the complainant, his father Jan Mohammad was coming from bank on 31st October 2013 when he was interrupted by two robbers near their house in Bilal Colony. In the meantime his brother Mukhtiar Lashari and neighbour Ayaz came out and shootout begun between robbers and them.
Jan Mohammad, Mukhtiar Lashari and Ayaz got injured in shootout. However, Lashari and Ayaz succumbed to their injuries later. One of the robbers was also killed in an encounter.
The ATC had awarded capital punishment to convict along with Rs 100,000 for murdering two persons and 10-year imprisonment for injuring a man.
