SHC seeks top officials reply in rape case

KARACHI: The Sindh High Court (SHC) on Monday issued notice to home secretary, provincial health secretary, IG Sindh, SSP Thatta and other officials to submit their respective replies on a petition seeking medical examination of alleged rape victim by a medical board.

Justice Mohammad Ali Mazhar, who headed a division bench of SHC, directed provincial law officer to file comments on petitioner by July 10. The petitioner, Shahdad Khan Chandio, who is a resident of Ghora Bari, an area of Thatta district, submitted in petition that her 11-year-old daughter was kidnapped from home and subjected to serious sexual assault on June 16.

He said that Ghora Bari police station did not register a rape case against accused at first for being influential but later they lodged an FIR against three following the court order.

The petitioner stated that her daughter was brought to Civil Hospital Thatta on June 23 for medical examination by police, where rape victim was examined and woman medical officer issued a report ruling out his claims regarding sexual assault.

He claimed that accused were very influential persons and medical officer, who medically examined rape victim, succumb to their influence and issued such report.

The petitioner further submitted that neither police took action against accused nor they have recorded the statement of victim under section 164 CrPC. He told the judges that he was being issued threats of serious consequences by accused if he did not withdraw the rape case against them.

He prayed to the court TO order constitution of medical board comprising doctors of Civil Hospital Karachi in order to medically examine her daughter. The court was also pleaded to order police to take action against accused and provide protection to him and his family.
