KARACHI: The Sindh High Court (SHC) on Thursday served a show-cause notice on Cantonment Board Clifton (CBC) chief executive officer and legal officer for showing disrespect to the court.
Headed by Justice Sajjad Ali Shah, a division bench was hearing a petition filed by Mubarak Masih, who moved the court seeking action against unlawful construction at Gizri Bazaar Road.
The petitioner alleged that CBC officials were involved in allowing illegal construction of ground-plus-seven-floor building at Gizri Bazaar Road. The building was being constructed without any approved plan and CBCs no-objection certificate, he said adding that the builder had covered compulsory-open-space, duct and also encroached three-feet wide street.
The court was pleaded to order demolition of the illegal building.
During the hearing, CBC’s counsel told the judges that action in accordance with the law would be taken against illegal construction within four weeks. The bench directed authorities to take action in accordance with law and submit a compliance report before this court on next date of hearing.
Two-judge bench noted that despite its direction, CBC head had failed to turn up before this court and his representative present in court says, “CEO had to attend the more important meeting in Islamabad than his appearance before this court.”
The judges came down hard on CBC’s superintendent (legal) for making such statement observing this statement per se is contemptuous and made in presence of counsel for CBC.
It ordered, “Let show-cause notice be issued to CEO to explain his position as to why proceedings for showing disrespect to this court be not initiated against him.” The court also issued show-cause notice to Javeed Mehmood Superintendent (legal) CBC to explain his position for making such derogatory statement.
It directed them to submit their respective responses within three days.
