Karachi: The Sindh High Court SHC put off the hearing bail plea of owners of Baldia garment factory, production manager and chowkidar of factory after special prosecutor sought time to file comments.
Amir Raza Naqvi on behalf of the applicants Arshad Abdul Aziz and Shahid Abdul Aziz submitted that investigation carried out by the police into factory fire incident was motivated and full of errors. Police have forced to witness to record their statement against the factory owners.
He submitted that version recorded in the FIR was motivated subsequently every effort was made only to strengthen the version of FIR instead bringing truth on the record.
He said that despite court orders police has failed to present forensic report of the incident in the court adding prosecution was trying to save some people by not presenting forensic report.
Khawaja Shams ul Islam on behalf production manager, Muhammad Mansoor submitted that his client is diabetic patient adding that when fire broke out in factory, his client fell unconscious and was taken to the hospital.
He said that prosecution has failed to produce any evidence against his client so there is no reason to keep his client behind the bars. Therefore he requested to court that bail be granted to his client.
M T Khan Counsel for Chowkidar, Arshad Mehmood, said that his client was also not present at time when deadly fire broke out. He said fire broke out at factory about 6 pm while his client’s duty time is from 11pm to 8 am yet he has been booked in this case.
Special prosecutor Shazia Hanjrah sought time to furnish replies to the points raised by the counsels of applicants. After that a Single member bench comprising Justice Ghulam Sarwar putt off the hearing till January 28.
