Petition filed against dismissal from job

Ratodero: A petition was filed by a citizen against dismissal from his job. The constitutional petition No:1129 of 2013 was filed in the Sindh High Court Circuit Court, Larkana, by petitioner Hafeez Dilbar Shaikh against Federation of Pakistan through Governor, State Bank of Pakistan, Islamabad, Chief Manager, EFU Life Assurance Ltd, Karachi, The Managing Director, EFU Life Assurance Company Ltd., Karachi, The Legal Department, Life Assurance Ltd office, Karachi and The Manager, Life Assurance Company Ltd, Branch Office, Larkana, through his advocate Asif Hussain M. Nawaz Chandio.

The petitioner submitted that he was appointed as a Branch Administrator Officer by the Chief Manager, Life Assurance Ltd with basic salary of Rs:5075/ along with other allowances total Rs:10,000/ per month and posted at Larkana Branch on August 24, 2012 with appreciation letter which stated that “it is our pleasure to welcome you to the EFU family and congratulate you on your decision to join us”.

He further stated that the petitioner was confirmed in grade II and was declared permanent member of the organization and his salary was increased by Rs1000per month from 01.02.2013 with all other benefits enumerated in a letter dated February 22, 2013 of the EFU Chief Manager.

The petitioner further stated that a Branch Manager Unit Agent having code No: 61174 was not happy with his posting and confirmation and developed ill will against the petitioner since then, as a result of which the petitioner was dismissed from the services without observing codal formalities.

He said hence the order of his dismissal is illegal void ab-initio because of the fact that he has been condemned unheard as no committee was formed by the company to investigate the matter and the legal department has violated the services discipline rules, thus the dismissal order is against the principle of law of equity and justice and clear violation of Article 25 of the Constitution.

He prayed the court to issue Writ of Mandamus against the respondents declaring the dismissal from service as illegal, ultra-vires without jurisdiction and they may be directed to reinstate the petitioner with the all the benefits.

The petition is fixed on 24thOctober for kacha peshi for which notices have been issued to all the respondents.
