SHC CJ supports appointment of judges purely on merit

KARACHI: Sindh High Court SHC outgoing Chief Justice Mushir Alam on Monday said that corruption is decreased to some extent in courts but it will take more time to be fully eliminated. Chief Justice was addressing a full court reference, which was held in the court room of the chief justice on a request of the SHC Bar Association to offer farewell to SHC chief justice, who has been elevated to the Supreme Court. Reference was attended by all SHC judges at the principal seat and a large number of lawyers.

He said that since he was elevated as the chief justice of the SHC he preferred appointment of the judges only on merit and did not compromise on quality and competence. He said that as chief justice SHC he had authority to appoint judges on his own but he did not use his discretionary powers in appointing even a peon at the court.

Chief Justice was of the view that it was better to leave the post of the judge vacant than to appoint incompetent and inefficient judges and added that country had to confront emergency on November 3, 2007 due to inefficiency of the judges.

He said that the day of November 3, 2007, when the state of emergency was declared in Pakistan, is observed as a ‘black day’ by lawyer community but it, according to him, is a golden day which pushed the judiciary to set the right direction.

He said that he had made substantial efforts to put an end to corruption in lower judiciary but some elements at district and sessions courts opposed such efforts as they did not want an end to corruption plaguing judiciary.

He said that he wanted to eradicate all kinds of discriminations from the country and added that everyone living in the country was a Pakistani irrespective of provincial and cultural background.

SHC’s Senior Puisne judge, Justice Maqbool Baqar, who has been elevated as next Chief Justice SHC, Sindh Bar Council Vice Chairman Muhammad Aqil, SHC Bar Association President Mustafa Lakhani, Karachi Bar Association President Naeem Qureshi, Prosecutor General of Sindh Shahadat Awan and Deputy Attorney General Zahid Khan also spoke.
