SHC issues notices on KU petition seeking quashment of FIA probe

Karachi: The Sindh High Court SHC on Monday put secretary of Interior Ministry, Director General Federation investigation Agency FIA, Director FIA, deputy director FIA, and other respondents on notice in a petition of University of Karachi, moving the court for quashment of enquiry of FIA regarding illegal appointments and various other allegations against management of University.

Petitioner, University of Karachi, through its deputy registrar, cited Federation of Pakistan through secretary of Interior Ministry, Director General Federation investigation Agency FIA, Director FIA, Altaf Husain, deputy director FIA, Abdul Rauf, Inspector FIA, Muhammad Zahid ex-chief security officer University of Karachi as respondents.

Petitioner through counsel Syed Mehmood Alam submitted that respondents no.6 ex chief security officer Muhammad Zahid applied for the post of chief security officer, following advertisement published on the 3rd March 2012 in various newspapers and after subsequent process he was selected for said post by vice chancellor of the university.

He said that respondent no .6 had introduced himself as retired Major which also helped him to secure that post, though he added that certificate issued by General Headquarters Rawalpindi revealed that he was a retired captain.

He submitted that respondent no . 6 remained absent without intimation from his duties adding for that purpose he was summoned by the registrar of university but he failed to appear and subsequently he was terminated from the service and a new security officer was appointed.

He said that ex security officer had challenged his termination in court but his petition was dismissed after that in order to blackmail the officials of the university he succeeded to mobilize FIA to and sent complaint in writing to FIA regarding his matter.

He stated that agency sent letter dated Jan 16, 2012, to the registrar stated that the subject inquiry Enquiry No 04/2012 of FIA had been registered against the management of the University of Karachi regarding illegal appointments and various other allegations.

He said that it was requested to provide the complete record of all the appointments made by the university from Grade 1 to 20 since Jan 2008 till to date.

He said that separate letters were received from the agency, adding agency also asked the university estate officer to appear in person at the FIA office in Karachi.

He said that the KU replied to the FIA saying that university of Karachi does not come under the jurisdiction of FIA, adding that again deputy director FIA sent two letters dated 23 January 2012 to registrar of the university seeking enquiry regarding the various illegal appointments.

He submitted before the court that the registrar of university responded to letters, saying inquiry as it is mala fide and illegal having no jurisdiction. It was said that the university management will not provide any document to agency.

He said that FIA authorities by sending again and again notices was harassing the management of university whereas he added that auditor general of Sindh conducts the audit of university and chancellor of the university regarding the promotions and dismissal of services of employees or other affairs, while FIA has no jurisdiction to initiate enquiry against the employees of the University.

Therefore petitioner prayed to court to quash the subject inquiry Enquiry No 04/2012 of FIA and restrain the respondents from harassing the management of university.
