Karachi: The Sind High Court SHC on Wednesday put federal and provincial law secretaries, speaker and deputy speakers of the provincial assembly of Sind and others on notice in a petition of Pakistan Muslim League-Functional PMLF against the caretaker setup of Sind province.
A division bench of SHC headed by Justice Maqbool Baqar also issued notices to attorney general and advocate general of Sind and put off the hearing to April 9.
PMLF leaders Jam Madad Ali and Nusrat Bano Saher Abbasi submitted through their counsel that MQM remained coalition partner of previous government for more than four years. Despite the fact, they added, the speaker provincial assembly appointment the leader of opposition from MQM, unconstitutionally.
They contended that their party unanimously had nominated Nusrat Bano Saher Abbasi for the opposition leader in Sind assembly and moved an application to speaker provincial assembly for her appointment. However, they added that for the considerable time decision on application remained pending.
They said that the PMLF went to the Sind High Court for appointment of opposition leader in the Sind Assembly and the court had ordered speaker of provincial assembly to appoint opposition leader within 10 days. They said that their party again filed contempt application against speaker of provincial assembly Sind for delaying opposition leader appointment.
They said that MQM and PPP in order to facilitate the caretaker setup of their own choice conspired and MQM parted its ways from government. They submitted that MQM was allotted opposition benches and opposition leader was nominated in the provincial assembly from this former coalition partner party.
They contended that Sind governor and opposition leader in Sind assembly belonged to the same party, adding as per law governor and opposition leader of same party could not install a caretaker setup.
They prayed the court to declare the current caretaker setup in province as against related laws.
