SHC restrains ECP from processing with election appeal against PPP winning candidate

KARACHI: Sindh High Court SHC on Thursday restrained the Election Commission of Pakistan from proceeding with election appeal against Pakistan People’s Party PPP winning candidate of constituency NA209.

A division bench of SHC headed by Justice Faisal Arab was seized with petition of PPP winning candidate on national assembly seat NA209 who sought suspension of proceedings against him before commission.

The petitioner, Mir Shabbir Ali Bijarani through his counsel submitted that respondent Tahir Hassan Khoso filed appeal before ECP against him alleging that he possessed fake degree. He said that appellant has requested the election commission for his disqualification as member national assembly MNA.

The petitioner said time for filing such appeal as prescribed under 103AA of Representation of the People Act 1976 has now expired and therefore his elections cannot be challenged. He requested the court to restrain ECP from initiated any proceedings against him. The court issued notice to respondents, ECP and Tahir Hassan Khoso, and adjourned the matter to September 10.s
