SHC restrains police from arresting freewill marriage couple

Karachi: The Sind High Court SHC on Tuesday issued notice to the official respondents and restrained the police from arresting a freewill couple who were booked in a case of kidnapping.

Marium and her husband Rashid Ali Chandio, residents of Gulshan-e-Iqbal, contracted marriage on February 9, 2013, after the women executed a freewill agreement at local court. Petitioner, Marium submitted that her family did not accept their marriage and being annoyed was harassing her husband and his family.

She stated that her family has got registered a FIR for kidnapping her on her husband in order to persecute them at Gulshan-e-Iqbal police station. Citing home secretary, SSP East, SHO Gulshan-e-Iqbal police station as respondents, they prayed to the court to direct the respondents to provide security to them and quash the FIR.

Headed by the Justice Maqbool Baqar, the division bench directed investigation officer to appear before court and place the relevant record before the court. It ordered Gulshan-e-Iqbal police that there shall be no arrest in respect to the subject FIR.

The courts also issued notice to prosecutor general and advocate general of Sind to file comments and adjourned hearing of case till March 20.
