Karachi: The Sindh High Court SHC on Tuesday ordered district registrar, Board of Revenue, Sindh to appear in the court on a petition of Cantonment Board Clifton CBC against mutation of property in its limits without consent of CBC.
The petitioner, Cantonment Board Clifton CBC through executive officer submitted that Inspector General of Registration Sindh Board of Revenue, and its subordinates and sub registrars, without getting no objection certificate NOC from the CBC, should not entertain any document for transfer of the property within the jurisdiction of CBC. He said that same is the case for Karachi Electric Supply Company KESC and Sui Southern Gas Company Limited SSGC connections.
He stated that in the limit of CBC more than 1200 buildings have been constructed without sanction of the board and most of the buildings are not stable structurewise and fit for living. He said that sub registrars of the Sindh Board of Revenue have entertained the documents without any NOC of the CBC and people without obtaining completion certificate have started residing in these building in violation of building laws.
He said that likewise KESC and SSGC have provided utility facilities.
Therefore he prayed to court to declare that any premises or building in limits of the CBC illegal until the certificate of no objection is obtained from the board.
He also pleaded to court to restrain provincial government from granting permission and registration to such buildings built without consent of CBC.
Earlier the court had issued notice to the subregistrar1 and subregistrar2 for filing comments in this regard. Today, the division bench of SHC, headed by Justice Maqbool Baqar was informed that both officers have been transferred. Therefore, the court ordered in person appearance of the District Registrar of BoR, Sindh.
The hearing of case was put off till April 4.
