SHC seeks comments on petition against transfer of inmate

Karachi: The Sindh High Court SHC on Tuesday directed Inspector General of Prisons to inform the court about the shifting of inmates from Central Prison Karachi to other central prisons of province and submit report regarding compliance of Rule 156.

Headed by Justice Sajjad Ali Shah, the division bench was seized with petition of Syed Nadeemul Haq who moved court against shifting of his son, convict Muhammad Arif Nizami, from central prison Karachi to central prison Hyderabad.

He submitted that he went on 10812 to visit his son in central prison Karachi and was told that his son had been shifted to Hyderabad jail. He said that his appeal is pending before this court; therefore, his transfer is in violation of the prisons rules.

The court observed that, perusal of the comments furnished on behalf of the IG prisons reflects that on account of safety and to avoid rush in the central prison Karachi, some of the prisoners were transferred including petitioner’s son.

The court further observed that such transfer of the prisoners, whose cases are pending in any court at Karachi, of course, would be a cause of great inconvenience both to the prisons authorities as well as prisoners and would be a cause of hindrance in dispensation of speedy justice.

The court ruled that let IG prisons to submit a report regarding compliance of Rule 156 and such report be furnished within 15 days.
