SHC seeks educational expenses for children of missing persons

KARACHI: Sindh High Court SHC on Monday while observing that right to education is fundamental right of children, directed provincial government to ensure that all education expenses of children of missing men are borne by it.

A division bench of SHC, headed by Chief Justice Mushir Alam gave this direction while hearing the petition filed by Bina Khalid seeking whereabouts of her missing husband, an account officer of the Karachi Water and Sewerage Board who is said to be missing since 6 Jan 2011.

She had submitted that as per media reports, her spouse was taken into custody by LEAs at Karachi airport along with other suspects in connection with assassination of MQM leader Dr Imran Farooq in London. But, LEAs were not disclosing whereabouts of detainee.

Statements have been filed by the official respondents stating that the whereabouts of Khalid Shamim has not yet been known. The bench observed that it is insisted that the missing man is in custody of law enforcing agencies, adding that whether the Law Enforcing Agencies are aware of the whereabouts of missing person, the court would examine such aspects later.

The petitioner submitted through her counsel that she is not able to support her son, Hunain and bear expenses of his education. The bench observed that right dispensation of right to education is fundamental right of the children. It further said that it is expected that the advocate general Sindh and deputy attorney general will not only ensure that the education expenses of child Hunain are met but children of all other missing persons are borne by the government of Sindh.

The court directed petitioner to provide the details of expenses including tuition fees, course material and other incidental expenses to enable the provincial government to ensure that such arrangements are made without ego as it should be the responsibility of the state to look after the family undergoing agony of missing of their dear ones.
